Below the PSM Threshold? The General Duty Clause Still Applies

We hear it all the time: "My facility is under the ammonia threshold, so compliance isn't a priority." Although some ammonia refrigeration systems avoid OSHA's Process Safety Management (PSM) standard by staying below 10,000 lbs. of total system charge, they're still required to adhere to the General Duty Clause (GDC). In ammonia industrial refrigeration, facilities must adhere to Recognized and Generally Accepted Good Engineering Practices (RAGAGEP) regardless of total system charge. RAGAGEP is what OSHA points to in defining a "recognized hazard" under the GDC. In other words, RAGAGEP applies to ammonia refrigeration facilities regardless of whether PSM does.
With few details offered in the OSHA standards themselves about what RAGAGEP requires, ensuring compliance can be confusing. The distinction that matters is whether your facility is following RAGAGEP, and if you can prove it through documentation.
The General Duty Clause Doesn't Care About Charge Size
Section 5(a)(1) of the OSH Act, better known as the General Duty Clause, requires every employer to maintain a workplace "free from recognized hazards that are causing or are likely to cause death or serious physical harm." Unlike PSM, the GDC has no charge-size threshold. If your facility handles ammonia at all, GDC applies. In practice, many facilities still need to implement most of a standard PSM program to stay compliant, even if the total charge is technically below the PSM threshold.
What the GDC Means in an Inspection
A citation can be issued with or without a history of incidents, based solely on whether RAGAGEP is being followed. Inspectors look for the same fundamentals: documented maintenance practices, properly trained operators, current equipment records, and evidence that recognized industry standards are being followed. All this falls under the General Duty Clause.
"We're too small for PSM" is not a defense OSHA accepts.
This catches a lot of facilities off guard. They've never built a formal PSM program, so there's no Mechanical Integrity schedule, no documented RAGAGEP compliance, and no paper trail if something goes wrong. Without documentation, a facility has no way to demonstrate GDC compliance during an inspection.

Ammonia facilities under the 10,000 lbs. threshold are still required to conduct several elements of PSM:
- A documented initial hazard/safety review — required no matter the size of the system
- The IIAR 9 Minimum System Safety Evaluation every 5 years
- Inspection/testing/maintenance and operating procedures that match current IIAR standards (IIAR-6 for ITM, IIAR-2 for design, per general RAGAGEP practice)
- Training must be kept up to date for facility operators
- Written procedures must be up to date
- Documentation proving all the above. Undocumented practice is functionally the same as no practice in an inspector's eyes
More Than a Compliance Checkbox
General Duty Clause enforcement typically accounts for between 1-3% of all OSHA citations. Since OSHA issues tens of thousands of citations annually, these are still significant numbers. But avoiding citations isn't the only reason RAGAGEP matters.
Beyond the regulatory exposure, RAGAGEP-based practices exist because they work. They’re the accumulated engineering knowledge of how to run ammonia systems safely. Avoiding a citation is the smallest reason to follow RAGAGEP. The real payoff is a system that's less likely to fail, leak, or injure someone.
